Measures for the administration of crop seed production and operation license
Chapter I General Principles
the first In order to strengthen the license management of crop seed production and operation, and standardize the order of crop seed production and operation, these measures are formulated in accordance with the Seed Law of People’s Republic of China (PRC).
the second These Measures shall apply to the application, examination, issuance and supervision of crop seed production and operation licenses.
Article The competent agricultural departments of the people’s governments at or above the county level shall be responsible for the acceptance, examination, issuance and supervision of crop seed production and operation licenses in accordance with the division of responsibilities.
Article 4 The competent agricultural department responsible for examining and issuing the crop seed production and operation license shall disclose the conditions and procedures for handling the crop seed production and operation license in the office.
Article 5 The competent agricultural departments shall, in accordance with the principles of ensuring agricultural production safety, improving the level of crop variety breeding and seed production and operation, promoting fair competition, and strengthening post-event supervision, strengthen the management of crop seed production and operation license according to law.
Chapter II Application Conditions
Article 6 An enterprise applying for a seed production and operation license shall have facilities, equipment, varieties and personnel suitable for seed production and operation, and meet the conditions stipulated in these Measures.
Article 7 An enterprise applying for a production and operation license for conventional seeds of major crops or seeds of non-major crops shall meet the following conditions:
(1) Basic facilities. Production and operation of conventional seeds of major crops, with office space of more than 150 square meters, inspection room of more than 100 square meters, processing plant of more than 500 square meters and warehouse of more than 500 square meters; Production and operation of non-main crop seeds, with office space of more than 100 square meters, inspection room of more than 50 square meters, processing plant of more than 100 square meters, warehouse of more than 100 square meters;
(2) Inspection instruments. It has inspection instruments such as purity analysis table, electronic scale, sample pulverizer, oven, biological microscope, electronic balance, sampler, sampler, germination box, etc., which meet the needs of routine testing of seed quality;
(3) Processing equipment. It has seed processing and packaging equipment suitable for its scale. Among them, the production and operation of conventional seeds of major crops should have complete sets of seed processing equipment, and the production and operation of conventional wheat seeds should have a total processing capacity of more than 10 tons/hour; Production and operation of conventional rice seeds, the total processing capacity of complete sets of equipment is more than 5 tons/hour; Production and operation of conventional soybean seeds, the total processing capacity of complete sets of equipment is more than 3 tons/hour; Production and operation of conventional cotton seeds, the total processing capacity of complete sets of equipment is more than 1 ton/hour;
(4) personnel. Having more than 2 professional technicians in seed production, processing, storage and inspection;
(5) varieties. Where conventional seeds of major crops are produced and operated, the varieties produced and operated shall pass the examination and approval, and there shall be more than one examined and approved variety corresponding to the applied crop category; The production and operation of registered crop seeds shall have more than one registered variety. The production and operation of authorized varieties of seeds shall obtain the written consent of the variety owner;
(6) Production environment. There are no quarantine pests in the production site, and there are isolation and cultivation conditions for seed production;
(7) Other conditions stipulated by the Ministry of Agriculture.
Article 8 An enterprise applying for a production and operation license for hybrid seeds of major crops and their parents shall meet the following conditions:
(1) Basic facilities. It has an office space of more than 200 square meters, an inspection room of more than 150 square meters, a processing plant of more than 500 square meters and a warehouse of more than 500 square meters;
(2) Inspection instruments. In addition to the conditions specified in the second paragraph of Article 7 of these Measures, it should also have PCR amplification instrument and supporting equipment for product detection, acidity meter, autoclave, magnetic stirrer, constant temperature water bath pot, high-speed freezing centrifuge, complete pipettes and other instruments and equipment, and be able to carry out seed moisture, purity, purity and germination rate detection and variety molecular identification;
(3) Processing equipment. With complete sets of seed processing equipment, the production and operation of hybrid corn seeds, the total processing capacity of complete sets of equipment is more than 10 tons/hour; Production and operation of hybrid rice seeds, the total processing capacity of complete sets of equipment is more than 5 tons/hour; Production and operation of hybrid seeds of other major crops, the total processing capacity of complete sets of equipment is more than 1 ton/hour;
(4) personnel. Having more than 5 professional technicians in seed production, processing, storage and inspection;
(5) varieties. The varieties produced and operated shall pass the examination and approval, and have more than one self-bred variety or one approved variety as the first breeder, or more than two approved varieties selected in cooperation, or more than three varieties that have been granted the variety right. The production and operation of authorized varieties of seeds shall obtain the written consent of the variety owner;
(6) Having the conditions specified in Item 6 of Article 7 of these Measures;
(7) Other conditions stipulated by the Ministry of Agriculture.
Article 9 An enterprise applying for a seed production and operation license that combines breeding, production and operation and has an effective area of the whole country shall meet the following conditions:
(1) Basic facilities. It has more than 500 square meters of office space and more than 200 square meters of cold storage. Production and operation of main crop seeds or potato seeds, with an inspection room of more than 300 square meters; Production and operation of other crop seeds, with more than 200 square meters of inspection room. Production and operation of hybrid corn, hybrid rice, wheat seeds or potato seeds, with a processing plant of more than 1000 square meters and a warehouse of more than 2000 square meters; Production and operation of cotton and soybean seeds, with a processing plant of more than 500 square meters and a warehouse of more than 500 square meters; Production and operation of other crop seeds, with a processing plant of more than 200 square meters and a warehouse of more than 500 square meters;
(2) Breeding institutions and testing networks. It has specialized breeding institutions and corresponding breeding materials, and has a complete scientific research and breeding file. Those who produce and operate hybrid corn and hybrid rice seeds have more than 30 test sites and corresponding facilities and equipment for sowing, harvesting and seed testing in different ecological areas of the country; For the production and operation of other crop seeds, there are more than 10 test sites and corresponding facilities and equipment for sowing, harvesting and seed testing in different ecological areas of the country;
(3) Breeding base. It has its own or leased scientific research and breeding base (with a lease term of not less than 5 years). Production and operation of hybrid corn and hybrid rice seeds, with more than 5 breeding bases distributed in different ecological areas, with a total area of more than 200 mu; Production and management of other crop seeds, with more than 3 breeding bases distributed in different ecological areas, with a total area of more than 100 acres;
(4) investment in scientific research. In the three years before the date of application, the average annual investment in scientific research shall not be less than 5% of the annual seed sales income, and the average annual investment in scientific research shall not be less than 15 million yuan for the production and operation of hybrid corn seeds; Production and operation of hybrid rice seeds, the average annual investment in scientific research is not less than 8 million yuan; Production and operation of other seeds, the average annual investment in scientific research is not less than 3 million yuan;
(5) varieties. For the production and operation of main crop seeds, the varieties produced and operated shall pass the examination and approval, and there shall be more than 3 national-level approved varieties as the first breeder of corresponding crops, or more than 6 provincial-level approved varieties (including at least 3 provinces approved), or 2 national-level approved varieties and more than 3 provincial-level approved varieties, or 1 national-level approved variety and more than 5 provincial-level approved varieties. The production and operation of hybrid rice seeds and the production and operation of conventional rice seeds should not only meet the requirements of hybrid rice varieties, but also have more than one national-level approved variety of conventional rice as the first breeder or more than three provincial-level approved varieties. Production and management of non-main crop seeds, should have the corresponding crops in the name of the enterprise to apply for the right to obtain new plant varieties of more than 5 varieties. The production and operation of authorized varieties of seeds shall obtain the written consent of the variety owner;
(6) Production scale. Production and operation of hybrid corn seeds, the average annual seed production area in the past three years is more than 20 thousand mu; Production and operation of hybrid rice seeds, the average annual seed production area of more than 10 thousand mu in the past three years; Production and operation of other crops’ seeds, the average annual seed production in recent 3 years is not less than 1 million mu of field seeds for this kind of crops;
(7) seed management. It has a sound sales network and after-sales service system. Production and operation of hybrid corn seeds, at least 1 year in the 3 years before the date of application, hybrid corn seeds sales of more than 200 million yuan or more than 1% of the national market share of such seeds; Production and operation of hybrid rice seeds, at least one year in the three years before the date of application, hybrid rice seeds sales of more than 120 million yuan or more than 1% of the national market share of such seeds; Production and management of vegetable seeds, at least 1 year in the 3 years before the date of application, vegetable seed sales of more than 80 million yuan or more than 1% of the national market share of such seeds; Production and operation of other crop seeds, at least 1 year within 3 years before the date of application, and its seed sales account for more than 1% of the national market share of such seeds;
(8) seed processing. With complete sets of seed processing equipment, the production and operation of hybrid corn and wheat seeds, with a total processing capacity of more than 20 tons/hour; Production and operation of hybrid rice seeds, the total processing capacity of more than 10 tons/hour (including pit cleaning equipment); Production and operation of soybean seeds, the total processing capacity of more than 5 tons/hour; Production and operation of other crop seeds, the total processing capacity of more than 1 ton/hour. Production and operation of hybrid corn, hybrid rice and wheat seeds should also have corresponding drying equipment;
(9) personnel. There are more than 10 professional breeders with bachelor degree or above or intermediate title who produce and operate hybrid corn and hybrid rice seeds; Production and management of other crop seeds, with a bachelor’s degree or above or intermediate title of professional breeders more than 6 people. Production and management of major crop seeds, with full-time seed production, processing, storage and inspection of professional and technical personnel each more than 5; Production and operation of non-main crop seeds, with full-time seed production, processing, storage and inspection of professional and technical personnel each more than 3;
(10) Having the conditions stipulated in Item 6 of Article 7 and Item 2 of Article 8 of these Measures;
(eleven) other conditions stipulated by the Ministry of agriculture.
Article 10 Enterprises engaged in seed import and export business and foreign-invested enterprises applying for seed production and operation licenses shall meet other conditions stipulated by relevant laws and administrative regulations in addition to the conditions stipulated in these Measures for issuing corresponding crop seed production and operation licenses.
Article 11 To apply for a seed production and operation license, the following materials shall be submitted:
(1) Application form for seed production and operation license (see Annex 1 for the format);
(2) Basic information such as the nature of the unit and the ownership structure, a copy of the company’s articles of association and business license, and an explanation of the establishment of branches, the entrustment of seed production, the entrustment of seed sales and the sale of seeds by purchase and sale;
(three) the basic information of the professional and technical personnel in seed production, processing, storage and inspection, and the copy of the social security certificate paid by the enterprise, the list of the legal representative and senior management personnel of the enterprise and their resumes in seed industry;
(four) the proof materials of the ownership or assets of the seed inspection room, processing plant, warehouse and other facilities; A copy of the certificate of ownership of the office or the lease contract; List of seed inspection and processing equipment and copies of purchase invoices; Description of relevant facilities and equipment and real-life photos;
(five) a copy of the variety approval certificate; If the seeds of authorized varieties are produced and operated, a copy of the certificate of new plant variety right and the written consent certificate of the variety owner shall be submitted;
(six) a copy of the seed production contract or a description and proof of the self-organized seed production;
(seven) the quarantine certificate of the seed production place;
(8) Other materials as prescribed by the Ministry of Agriculture.
Article 12 To apply for a seed production and operation license with a combination of breeding, production and operation and an effective area of the whole country, in addition to the materials specified in Article 11 of these Measures, the following materials shall also be submitted:
(a) the certificate of its own scientific research and breeding base or a copy of the contract for renting the scientific research and breeding base;
(2) A description of the variety test network and test sites, as well as photocopies of ownership certificates and live photos of corresponding equipment and facilities such as sowing, harvesting and drying;
(3) Description and certification materials of breeding institutions, scientific research investment, breeding materials and scientific research activities, basic information of breeders and copies of social security certificates paid by their enterprises;
(four) the location, area and contact person of the seed production base in recent three years, and other information and certification materials;
(five) the information and certification materials of seed business volume, business volume and market share;
(six) the construction of sales network and after-sales service system.
Chapter III Acceptance, Examination and Issuance
Article 13 The seed production and operation license shall be examined and issued at different levels.
(a) engaged in the production and operation of conventional seeds of major crops and non-major crops, the seed production and operation license shall be issued by the local agricultural authorities at or above the county level where the enterprise is located;
(2) The seed production and operation license of a seed enterprise engaged in the production and operation of hybrid seeds of major crops and their parents, as well as the combination of breeding, production and operation, whose effective area is the whole country, shall be examined and approved by the county-level agricultural authorities where the enterprise is located and issued by the agricultural authorities of provinces, autonomous regions and municipalities directly under the Central Government;
(three) engaged in the import and export business of crop seeds, the seed production and operation license shall be audited by the competent agricultural departments of the provinces, autonomous regions and municipalities directly under the central government where the enterprise is located, and issued by the Ministry of Agriculture.
Article 14 The competent agricultural department shall deal with the application for seed production and operation license put forward by the applicant according to the following circumstances:
(1) If it is not necessary to obtain a seed production and operation license, it shall immediately inform the applicant that it will not accept it;
(two) does not belong to the scope of authority of the department, it shall immediately make a decision not to accept, and inform the applicant to apply to the relevant departments;
(3) If there are errors in the application materials that can be corrected on the spot, the applicant shall be allowed to correct them on the spot;
(4) If the application materials are incomplete or do not conform to the statutory form, the applicant shall be informed of all the contents that need to be corrected on the spot or within five working days. If the application materials are not informed within the time limit, it shall be accepted as of the date of receipt of the application materials;
(5) If the application materials are complete and conform to the statutory form, or the applicant submits all the corrected application materials as required, it shall be accepted.
Article 15 The auditing organ shall examine the materials submitted by the applicant, conduct on-the-spot investigation on the applicant’s office and facilities and equipment such as seed processing, inspection and storage, and check the original relevant application materials.
The auditing organ shall complete the auditing work within twenty working days from the date of accepting the application. With the provisions of these measures, the signing of the audit opinion, reported to the nuclear.
Issuing authority; If the audit is not passed, the applicant shall be notified in writing and the reasons shall be explained.
Article 16 The issuing authority shall complete the issuance work within twenty working days from the date of accepting the application or receiving the examination opinions. If the issuing authority deems it necessary, it may conduct on-the-spot investigation and check the original. In line with the conditions, the seed production and operation license shall be issued and announced; Do not meet the conditions, notify the applicant in writing and explain the reasons.
The seed production and operation license, which combines production and operation, and the effective area is the whole country, shall be publicized in China Seed Industry Information Network for five working days before it is issued.
Chapter IV License Management
Article 17 The seed production and operation license shall have a main certificate and an auxiliary certificate (see Annex 2 for the pattern). The main certificate indicates the license number, enterprise name, unified social credit code, domicile, legal representative, production and business scope, production and business mode, effective area, expiration date, issuing authority and issuing date; The supplementary certificate indicates the crop type, seed type, variety name, approval (registration) number, seed production place, etc.
(1) The license number is "__(xxxx) Nongzhong Xuzi (xxxx)No. xxxx". "_ _" is marked with the type of production and operation, in which A is the combination of breeding, production and operation, B is the hybrid seeds of main crops and their parents, C is the seeds of other main crops, D is the seeds of non-main crops, E is the import and export of seeds, and F is a foreign-invested enterprise; The first bracket is the abbreviation of the location of the issuing authority, and the format is "province, prefecture and county"; The second bracket is the year number when the certificate was issued for the first time; "No.xxxx" is a four-digit serial number;
(two) the scope of production and business operation shall be filled in by the name of the crop that produces and manages seeds, and vegetables, flowers and hemp shall be filled in by the crop category;
(3) The mode of production and operation shall be filled in according to production, processing, packaging, wholesale, retail or import and export;
(4) Effective area. The effective area of seed production and operation license combining breeding, production and operation is the whole country. The effective area of other seed production and operation licenses shall be determined by the issuing authority within its jurisdiction;
(five) the place of production is the place where the seeds are produced, and the hybrid seeds of the main crops are marked to the county-level administrative region, and other crops are marked to the provincial administrative region.
The seed production and operation license is marked with the license information code. The license information code shall include the relevant contents of the seed production and operation license, which shall be automatically generated by the issuing authority when printing the license certificate.
Article 18 The effective area specified in the seed production and operation license refers to the area where the enterprise sets up branches.
The location of seed production is not restricted by the effective area specified in the seed production and operation license, and is determined by the issuing authority according to the copy of the seed production contract submitted by the applicant and the certificate of no quarantine pests.
Seed sales activities are not restricted by the effective area specified in the seed production and operation license, but the terminal sales place of seeds should be in the appropriate area for variety approval, variety registration or labeling.
Article 19 The seed production and operation license is valid for five years.
In case of changing the items specified in the main certificate within the validity period, it shall apply to the original issuing authority for change and submit corresponding materials, and the original issuing authority shall conduct examination according to law and go through the formalities for change.
In the period of validity, if the variety and place of seed production specified in the supplementary certificate are changed, the original issuing authority shall apply for the change and submit the corresponding materials 30 days before sowing. If the application materials are complete and conform to the statutory form, the original issuing authority shall change the registration on the spot.
If the seed production and operation license continues to engage in seed production and operation after the expiration, the enterprise shall re-apply six months before the expiration.
Article 20 During the validity period of the seed production and operation license, the issuing authority shall cancel the license and make an announcement in any of the following circumstances:
(a) the enterprise has stopped production and business activities for more than one year;
(two) the enterprise no longer has the licensing conditions stipulated in these measures, and it still fails to meet the requirements after rectification within a time limit.
Chapter V Supervision and Inspection
Article 21 Under any of the following circumstances, it is not necessary to apply for a seed production and operation license:
(a) farmers have surplus conventional seeds for their own use, which are sold or exchanged in local markets;
(two) the establishment of branches in the effective area specified in the seed production and operation license;
(three) specialized in packaging seeds that are no longer repackaged;
(four) entrusted in writing by an enterprise with a seed production and operation license to produce and sell its seeds on a commission basis.
The term "farmers" as mentioned in the first paragraph of the preceding paragraph refers to farmers who sign rural land contracts in the form of household contract responsibility system; The term "local bazaars" refers to the township (town) area where farmers are located. The number of seeds sold or exchanged by individual farmers should not exceed the annual seed consumption of contracted land for household production. Whoever sells or exchanges seeds in violation of the provisions of this paragraph shall be regarded as producing and operating seeds without a license.
Article 22 The branch established by the seed producers and operators in the effective area specified in the seed production and operation license shall be filed with the local county-level agricultural authorities within fifteen working days after obtaining or changing the business license of the branch. At the time of filing, a copy of the business license of the branch, a copy of the seed production and operation license for the establishment of the enterprise, and the name, domicile, person in charge, contact information and other materials of the branch shall be submitted (see Annex 3 for the style).
Article 23 Specializing in packaged seeds that are no longer repackaged or entrusted in writing by enterprises with seed production and operation licenses to sell their seeds on a commission basis shall be filed with the local county-level agricultural authorities before seed sales, and a seed sales ledger shall be established. At the time of filing, a copy of the business license of the seed seller, a copy of the seed purchase and sale certificate or a copy of the consignment contract, as well as the seed seller’s name, domicile, mode of operation, person in charge, contact information, sales place, variety name, seed quantity and other materials (see Annex 4 for the style) shall be submitted. The seed sales ledger shall truthfully record the variety name, seed quantity, seed source and seed destination of the seeds sold.
Article 24 If an enterprise with a seed production and operation license entrusts in writing to produce its seeds, it shall file with the local county-level agricultural authorities before sowing the seeds. At the time of filing, it shall submit a copy of the seed production and operation license of the entrusted enterprise, the entrusted production contract, and the seed producer’s name, domicile, person in charge, contact information, variety name, production place, production area and other materials (see Annex 5 for the style). Entrusted with the production of hybrid corn and hybrid rice seeds, it shall also submit the production agreement with the farmers, farmers’ cooperative organizations or village committees where the production is located.
Article 25 Seed producers and operators shall establish archives of seed production and operation, including original records or vouchers formed in seed field production, processing and packaging, sales and circulation, etc. The specific contents are as follows:
(1) Field production: technical person in charge, crop category, variety name, parent (original seed) name, parent (original seed) source, production place, production area, sowing date, isolation measures, quarantine of origin, harvest date, seed yield, etc. Commissioned seed production, it should also include the seed production contract.
(2) Processing and packaging: technical director, variety name, production place, processing time, processing place, packaging specifications, seed batch, labeling, warehousing time, seed quantity, quality inspection report, etc.
(3) Circulation sales: the manager, the name and address of the seed sales object, the name of the variety, the packaging specifications, the sales quantity, the sales time and the sales bills. Bulk purchase and sale, should also include the seed purchase and sale contract.
Seed producers and operators shall keep the archives of seed production and operation for at least five years to ensure that the information recorded in the archives is continuous, complete and true, and to ensure traceability. If the archival materials contain copies, the time of copying shall be indicated and signed by the relevant responsible person.
Article 26 Seed producers and operators shall keep the seed samples produced and operated by batches, and the samples shall be kept for at least two production cycles of such crops.
Article 27 If the applicant intentionally conceals relevant information or provides false materials to apply for a seed production and operation license, the competent agricultural department shall not grant the license, and record the applicant’s bad behavior and incorporate it into the credit information system. The applicant shall not apply for a seed production and operation license again within one year.
If the applicant obtains the seed production and operation license by cheating, bribery or other improper means, the competent agricultural department shall revoke the seed production and operation license, and record the applicant’s bad behavior into the credit information system. The applicant shall not apply for a seed production and operation license again within three years.
Article 28 The competent agricultural department shall supervise and inspect the seed production and operation, and deal with the illegal acts that do not conform to these measures in accordance with the relevant provisions of the Seed Law of People’s Republic of China (PRC).
The relevant information about the issuance, revocation, revocation and cancellation of the seed production and operation license shall be published by the competent agricultural department according to law, and the information shall be updated in time on the China Seed Industry Information Network.
The competent agricultural departments and their staff shall keep confidential the business secrets of seed producers and operators learned in the management process.
Article 29 The competent agricultural department at a higher level shall supervise and inspect the seed production and operation license of the competent agricultural department at a lower level. In any of the following circumstances, it shall be ordered to make corrections, and the directly responsible person in charge and other directly responsible persons shall be given administrative sanctions according to law; If the case constitutes a crime, it shall be transferred to judicial organs for criminal responsibility according to law:
(1) Failing to issue the seed production and operation license according to the issuing authority;
(two) to lower the issuance standard and issue the seed production and operation license without authorization;
(three) other seed production and operation licenses are not issued according to law.
Chapter VI Supplementary Provisions
Article 30 The term "seed production and operation" as mentioned in these Measures refers to the activities of planting, harvesting, drying, cleaning, grading, coating, packaging, labeling, storage, sales and import and export of seeds; Seed production refers to the field activities of planting and harvesting breeding (production) seeds.
Article 31 The term "complete sets of seed processing equipment" as mentioned in these Measures refers to the processing system in which the host machine and supporting system are matched and fixedly installed in the processing plant room to realize the basic functions of seed selection, coating, metering and packaging. The main engine mainly includes air screen cleaner (the air separation part should have front and rear suction ducts and double settling chambers; The screening part should have more than three layers of screens), specific gravity cleaner and computer metering and packaging equipment; The supporting system mainly includes conveying system, storage system, dust removal system, impurity removal system and electric control system.
Article 32 The facilities and equipment for scientific research, breeding, production, processing, inspection, storage, etc. as stipulated in these Measures shall be the own property rights or assets of the applicant enterprise, or the own property rights or assets of its absolute holding subsidiary. The office space should be in the administrative area under the jurisdiction of the seed production and operation license issuing organ and can be leased. The self-owned variety of the absolute holding subsidiary of the applicant enterprise can be regarded as the self-owned variety of the applicant enterprise. The absolute holding subsidiary of the applicant enterprise may not apply for seed production and operation license by repeatedly using the above conditions.
Article 33 The term "packaged seeds that are no longer repackaged" as mentioned in these Measures refers to the smallest packaged seeds that are packaged according to relevant regulations and standards and are no longer split. Those who sub-package seeds shall obtain a seed production and operation license, ensure the integrity of seed packaging, and be responsible for the sub-packaged seeds.
Seeds and fruits of sexually propagated crops, including caryopsis, pod, capsule, drupe, etc., and miniature virus-free potato seeds should be packaged. Organs and tissues that reproduce asexually, seedlings and non-grain seeds that are not suitable for packaging can be unpacked.
Seed packaging shall conform to the relevant national standards or industry standards.
Article 34 Provisions on the management of seed production and operation license of genetically modified crops shall be formulated separately by the Ministry of Agriculture.
Article 35 Those who apply for the seed production and operation license of fresh and popcorn shall be handled according to the licensing conditions of non-main crop seeds.
Article 36 The production and operation of organs and tissues that reproduce asexually, seedlings, seed potatoes and non-grain seeds that are not suitable for packaging shall have suitable facilities, equipment, varieties and personnel. The specific measures shall be formulated by the provincial agricultural authorities and reported to the Ministry of Agriculture for the record.
Article 37 In an administrative region where there is no competent agricultural department, the seed production and operation license shall be examined and issued by the competent agricultural department of the higher administrative region.
Article 38 The seed production and operation license shall be uniformly printed by the Ministry of Agriculture, and the relevant form format shall be uniformly formulated by the Ministry of Agriculture. The application, acceptance, examination, issuance and printing of seed production and operation licenses, as well as the record management of seed production and operation, are carried out in China Seed Industry Information Network.
Article 39 These Measures shall come into force as of August 15, 2016. The Measures for the Administration of Crop Seed Production and Business License issued by the Ministry of Agriculture on February 26, 2001 and revised on April 29, 2015 and the Provisions on the Processing and Packaging of Crop Commercial Seeds issued on February 26, 2001 shall be abolished at the same time.
The validity period of the crop seed production and business license obtained before the implementation date of these Measures remains unchanged. For enterprises whose validity period is from the date of promulgation of these Measures to August 15, 2016, the validity period of their original seed production and business license will be automatically extended to December 31, 2016.
Before the implementation of these measures, the crop seed production and business license has been obtained, and within the validity period, the application for changing the matters specified in the license shall be handled according to the procedures stipulated in Article 13 of these measures.
